Americas: Duty of Care and The OSHA Emergency Vaccine Standard

The Occupational Safety and Health Administration (OSHA) recently released an emergency temporary standard. It requires private employers with 100 or more employees to require COVID-19 vaccination. Otherwise, it requires weekly testing and masking for employees who choose to remain unvaccinated.

The rule is currently tied up in the courts. The standard (if allowed) will require employers to ensure all unvaccinated employees working in person wear masks. It will also require to provide a negative COVID-19 test on a weekly basis. How can employers prepare for this rule? What’s the best way to communicate with employees?
